There are two options.

1. The commission established by the KKTC will be recognized as an “effective domestic judicial body” and the plaintiffs of the awaiting cases will be asked to apply to the commission first.

2. It will decide that the commission in the KKTC could not be impartial and the Loizidu case will be treated as a precedent for the thousands of cases currently pending. In other words, Turkey will be forced to pay billions of dollars in compensation.

The clock is ticking. The only way to stop the clock is to prove that “impartial” people form the commission in the KKTC and it can make just and fair decisions.

Isn't this a contradiction? It is like they are admitting that they are guilty (since they admit that if ECHR was handling the cases they would have to pay billions), and at the same time they say that they have to create an "impartial" commission so that Turkey will not have to pay billions.

But if the commission was indeed impartial, then the result would have been exactly the same as the ECHR result ( = Turkey paying billions)

The property exchange commission in the north will never be legalised by the ECHR because it fundamentally denies the rightful owner of a property in the occupied areas to be given unhindered and unrestricted access to peacefuly enjoy their property.

The Loizidou case in the ECHR is still pending. Loizidou has already been compensated for the loss of use of her property by Turkey. The final part of that decision, the right for Loizidou to gain unrestricted and unhindered access to her property, is to be decided upon this year.
