property case in European Court Human Rights

How can we solve it? (keep it civilized)

property case in European Court Human Rights

Postby reportfromcyprus » Fri Dec 08, 2006 8:32 am

Xenides-Arestis won 850,000 euros in her case against Turkey; it took some time to understand this judgement.

It appears that the ECHR still supports the idea of local remedies through the immovable property commission, just not in her case because she updated her claim to "just satisfaction", not only compensation or other kinds of settlement.

Anyway, they haven't rejected the immovable property commission yet.

Any thoughts?

I think Ms Xenidis- Arestis ought to be allowed to return to her property if that is what she is choosing.

From what I understood of the case, she doesn't actually want that (at least not as the situation stands). She wants compensation for not having access to her property at the same time as keeping all the rights to her property.

The commission they set up in the north only covers restitution, compensation or exchange of properties, and her case wasn't covered by any of that.
