It has been a criminal offence in north Cyprus to write a check with no credit to back it up and I believe that a similar law was passed in south Cyprus only a couple of years ago.

In cyprus debt is not a civil matter. One could nd in jail at no time!

So they are were saying, that we are still 50 years behind in some simple matters

Thanks Andri_cy. I figured that much that CID was not a law firm.!!! I was referring to what they told Hunter, to go and seek a lawyer.

Sorry, I do not know if you live in Cyprus (if so you may be as, or more, familiar with the culture here) but the fact that the Police don't want to pursue a matter does not mean it is not an illegal activity, it means that they simply cannot be bothered. I have a friend who spent time in Nicosia Jail, because of her bad debt.

I appreciate that in most countries this is not a criminal matter but my understanding, backed by the lawyer I called yesterday, suggests that it is here.

Lana,

I was not trying to contradict you by any means, and since you live there and I don't, you must know what you're talking about.

This in fact brings up many interesting questions in that case.

1.Why have a law, that there's no intention being carried out.?

2. Are all debts criminal offences, or only if there is a contract signed.??

3. What if you can't pay your Credit Card bills, House mortgage/ Rent, Car payments, and so on.??

4. Can one file for Bankruptcy, if one can't pay their debts, or is that also a criminal offence.??

I smell a big smelly fish here, and that is, as in most countries, the lawyers have gotten their way with the "law makers" to make almost all debts a criminal case, to benefit themselves, by defending the "guilty party". No wonder lawyers get to have the worse reputation anywhere in the world. Even worse than sleazy, dirt bag, lying through their teeth, ugly used car salesman. !!

We love all the good used car salesman of course.

Good questions, I know that in some countries you do go to jail for not being able to pay your debts but Cyprus law system is based on UK. The basic point here is that one does not go to jail for not paying debts but can be sent to jail for disobeying Court Order.
As I explained before, on the application of the Plaintiff, the court will examine the income of the judgement debtor and order him to pay so much per month, a reasonable amount for his income. He will go to jail only if he does not obey the court order *deliberately* i.e. if his income has not deteriorated since the last order and has failed to pay.
