The Orams case

The findings on the Orams case wont be known till september or october, i am interested in the outcome as this will set a precedents.. Does anyone have any guesses as to how it will go? What are the options possible, without it getting too radical.. sensible answers on a postcard to.... sorry got carried away then. :oops:

The only outcome as I see it is this. The judge will tell the complainant that there is a court in the North dealing with exactly this type of dispute and should apply there.

a Court in Nicosia says the land on which property is built should be given back to owner as they own the title deeds.

b The decision of court is not recognised by authorities in occupied area.

c Owners of land appealed to high court in london to force siezure of Orams property in Uk to pay compensation.

d Whatever the decision it will have nothing to do with authorities in occupied areas. As the case is regarding seizure of property in UK owned by Orams and nothing to do with repossession of property in north.

What a bag of worms this could open up for property owners both north and south.

Anyway as to what is going to happen..... Sorry hav'nt got a clue

The judge said it was an extremely complex point of law. He might refer the case to the Immovable Property Commission in the occupied areas, for local remedies, like the ECHR did for Aristides' case. Any decision they make wouldn't be recognised by the government, though, because they want to prove this commission illegal.

the outcome will only decide about their uk property... the cyprus property will still be under dispute

Spot on GMan

That was the point I was trying to get over in my post. The decision of the UK court has nothing to do with the disputed property in Cyprus

if the the case does indeed get thrown out then it will have a major impact on the property situation in the North....If british people thought they would lose their UK assets then they would think twice about buying!!! By the way I have decided not purchase in the North, South, East, or West of Cyprus, I am off to Turkey instead what lovely people!!!

I monitor the sale of property in the north closely; sales are very quiet, slaes of 'resales' (previously owned properties) virtually non-existent.
Having said that the property market in the RoC is also slow.
