Today i received this email asking for your help, if there are any in the legal profession who have come across anything similar, i would appreciate advice and the legal outcome. Because this is a crazy logic in anyones book, and my friend is unable to find a job in her specialist field because of this.
Dear Lesley,
Can you possibly float this on the forums please.
"I am a nurse. Entered into full time employment (written contract) with
local clinic and worked for them for 5 years paying social security &
taxes, etc. Duties included emergency duties, intensive care & general
nursing. In the last year of work become Cypriot national. I paid social
security & taxes for the whole 5 years. On leaving work I was given work
references.
Left work and secured a similar position with another registered clinic
on the basis that I have had local on-hand nursing experience of 5
years. The new clinic declined to recognise my experience because my
previous employer did not fill in appropriate government form, etc.
Asked government department for clarification and was told that as far
as the government is concerned any experience that I gained working at
the clinic was actually gained 'illegally' and therefore can not be
recognized as 'experience'.
And that the only experience that can be recognised is the 1 year of
working after I become Cypriot citizen. I feel that is grossly unjust.
The agreement that I have had with my previous employer was legal and
was the basis of my stay on the island. The authorities were informed &
well aware who I was working for. Is there anything open for me to do
to have the 4 years of my work officially recognised?"
