Cyprus: the way forward - by Tassos Papadopoulos

How can we solve it? (keep it civilized)

Postby metecyp » Thu Oct 28, 2004 9:26 pm

Ibrahim Aziz a TC living in the free areas went to the EU court suing the RoC for not allowing him to vote. He won the case and the RoC paid all the expenses of the trial. According to the Court there was no monetary compensation, other than paying all the expenses for the trial and all the expenses of Ibrahim.

Does this mean that all TCs with RoC passports can vote for the president? I don't think so.

I think the they are considering ways to fix this. The ECHR ruling was that Aziz was living in the government-controlled areas for 30 years now but didn't have the right to vote, which is a human rights violation. So I guess we might see some changes in the next elections (municipal in a year's time, right?). I wouldn't be surprised if all citizens were given the right to vote, provided that they enrol on the electoral list. Perhaps they will allow this for everyone that is a permanent resident in the government-controlled areas. They might have a problem with definitions though (such as the definition of "TC" in the law for how the TC properties in the government-controlled areas are managed).

There are, in fact, other important constitutional changes that have to be made soon - for example we need to enforce that EU law is above the member state laws etc. These are impossible as a special majority is required from both communities' representatives. An idea would be to have a referendum instead, in which all RC citizens would have the right to vote, and make a bunch of changes to the constitution. But my guess is that they are deferring this until later, when the first problem appears. Or they will make the changes provided that the constitutional court will allow this (in the past it turned changes down)...

so am i understanding this right, if you do not complain the ROC will just keep chewing the tc rights and despite its claims that it practices human rights etc. these actually only imply to the gc population and not the tc population.

If so how can tassos make the claims that he is fighting for all cypriots rights when this is blatently absolute rubbish.
