Hi everyone,just a very random question my name is Les Walker,I live in Cheshire UK and I live with major heart problems,I'm a gay guy so you can imagine what I was like when my mother passed away,my own brother and sister ran away to Paphos leaving me with nothing as they said that there was a will and that I had no chance of anything as I was not included in it,well 4and a half years on I am still waiting to see this legal document I have my brothers email address if any one wants to help me out there names are Mrs Vicky Watson(sister) and Robert Walker(brother) can anyone give me there address as I feel to hide this is just pure guilt please help Paphos forum with so much appreciation thankyou.

Your mom must've had an “Executor” (or personal representative) responsible for settling her estate upon her death. This person will have a copy of the will and should’ve sent a copy to all beneficiaries.

Hi thanks so much for your message regarding the will hunter,I know deep down there isn't even a will,hence no contact details,it's my own brother who is prolonging the agony,because I'm gay and my brother is x army his words to me were I can fucking swivel for it as I wasn't included in which he ends his email with just off to the bar to spend mums money(bastard) he knows how close we were.this has been going on now for four and a half years all my brother is saying now that I am sick in the head for even asking! His email address is [email protected] you say he even says he was power of attorney and he will blow the fucking lot up if I get my hands on anything,another extremely guilty comment,all I want is to see this legal document as to make someone wait who suffers with chronic heart disease let me just say I'm a broken man 2heart attacks and two lots of open heart surgery and I have begged him for it what more can I do any help would be so much appreciated I have to or I'm trying my hardest to get these details before I die sorry tears now!!!! Sounds like a very nasty piece of work.

I would suggest you get some legal advice. You have an entitlement to your mother's estate and you need to be taking this matter to the family courts for arbitration.

In the UK, a Citizen's Advice Bureau may be a good place to go to get some initial free information especially as to where you stand under the law.

My understanding is that in civil law jurisdictions, there is a reserved part of the estate that is divided by automatic operation of the law, and children or spouses can never be disinherited. Traditionally, under common law, though, (and common law applies in England) I believe that the will was once king, and people were entitled to leave their estate to whoever they wished and so be it, even if they disinherited their children or spouse. However, it seems that this matter has now been regulated in the UK under the 1975 Inheritance (Provision for Family and Dependents) Act and brought more into line with civil law practice, so that a child may demand part of the estate. Good legal advice is called for, if you ask me, before you do anything else. Certainly, if you can get a judgment in the English courts, then it can be enforced and executed in EU-member Cyprus. It would then be the job of the authorities here to track these people down, if need be.

Thankyou so much for your reply,that's the major problem I don't have any finances to do this as quoted by my brother ( I wouldnt be able to fight him as I have no fucking money with your dicky heart rrrrrrrr) they were his words,the most distressing part is I know deep down my mum didn't make a will this is why he is prolonging the agony as he is now shitting himself because I'm back on his case.thanks again for your much appreciated advice.

What about legal Aid in the UK?

You might need to challenge this matter in the UK, and then have the judgement enforced in Cyprus if your Brother lives in Cyprus.

I had a similar problem. My sister din’t know where my Mothers will was when asked and told me that she was the sole beneficiary and executor. I contacted the Registrar for Births, Marriages and Deaths in the jurisdiction where she died and for £20 they sent me a copy of the will. It can all bedone from your PC, no need to visit.

I left it too late to do anything because I trusted in what my sister told me even though my Mother had never said anything to me. My Mother and I were on good terms and she was close to my wife. There was clear evidence that the Will was in fact a forgery produced by my sister and her husband maybe just a short time before her death. They worked on the principal that nobody would know, as I was in Cyprus and I fell for it because I trusted their word instead of checking it out there and then for myself.

But there is a time limit 3 years I believe (?) during which period you can contest the will. If there is no will ........... the law applies.

Try the Registrar first, if they have no record go to the Citizens Advice Bureau and tell your story ...... keep any correspondence you have. They sound a bit like my sister and her husband!!! Rest assured if they don’t get their come-uppance in this World, it will follow them beyond the grave.

Thankyou so much for your response firstly how do we get over this when I will 100% admit that I am a gay mummy's boy lol I was so so close to her,when you talk about karma my sister who is also 100% involved has lost her husband to cancer,my brother suffers now with heart problems and my sister also has health issues,this was all done while I was having a triple bypass from two previous heart attacks the sale of house and contents and my brother and sister telling me while I was in hospital that they have had to sell the family home to put mum in a bupa home,since it all began I have now found out her care was free and he and she knows I have 100% RUMBLED them! They have just sent me a mail asking me why didn't I care for mum this much while she was alive( cheeky fucking bastards) excuse my language I'm gonna have to go can't see for tears sorry.
