Under the existing Schengen acquis the EU Council can suspend a member from Schengen for up to 2 years. It can only do this following a Schengen evaluation report on that member that identifies serious deficiencies. The Commission then draws up a plan of what that member needs to do to address these serious deficiencies, which if adopted by the EU Council then places a 3 month time limit on that member to carry out these measure. If the member states fails to do this in the three month period set then the Council can suspend that member from Schengen for up to 2 years.
