The nightmare is nearly over. Today at the Famagusta court in the north of Cyprus, justice prevailed for the Turkish speaking Cypriots, Koray Basogrultmacı and Cinel Senem Husseyin, whose charges pertaining to flying 3 Republic of Cyprus flags in June 2013 outside their home and shop in Famagusta, were dismissed. The female judge stated that ‘there was not enough evidence to prove their guilt in any of the charges’.
Together with 20 supporters from both sides of the divide and no Grey Wolves in sight, the couple stood in the courtroom for an hour whilst the judge presented her decision. She had previously ruled that it ‘was not illegal to fly the Cyprus flag’ and repeated this statement again today. Citing that the couple had ‘freedom of expression’ to be able to state their sentiments concerning the Cyprus flag and non recognition of the TRNC was also a surprising statement by the judge. She also said that the police account of 15-20 people’s complaints regarding the couple flying the flag in June 2013 did not comply with the one witness who testified under oath that he alone complained to the police. Other witnesses who had said that they had found the flag ‘offensive’ appeared to somehow forget that they made official complaints. This in fact contradicted the original police reports prompting the judge to question the evidence provided.
When she announced that all the charges – Public Disorder, Non recognition of the TRNC and the new charge which was added recently of conspiracy to undermine and insult the breakaway regime,were dismissed and that Cinel and Koray wre acquitted, there were tears of joy and relief for the couple, their family and supporters. The Prosecution now has 14 days in which to appeal for the case to go to the Supreme Court.
Cinel clearly moved by today’s verdict stated “we are happy, this is not just our victory but it’s every Cypriots victory and we wish to thank every single person who has supported us, a simple thank you is not enough”. ..."
