Orams case will make it possible to get a judgement made in the RoC to be executed against Turkey in the rest of the EU countries where Turkey has assets. Once this case becomes a test case, then many others will be able to sue Turkey as well, including TCs like Lordo!
The CyBc said the other day that something changed in the EU lately that made seizing of assets -in this case Turkish assets- becomes automatic without any further court decisions whereas in the Orams case it had to be verified by a British court.
We will see...
If this becomes a reality then there will be an avalanche of bricks falling on Turkey's head. Imagine she will not even be able to deposit money for her ambassadors in Europe.
And perhaps THIS COULD BRING THE SOLUTION WE ARE ALL SEEKING IN THIS FORUM
Well... as Pyro has let One of the Cats out of the Bag...
Yes, there are now much easier to use EU Regulations. Became effective soon after Xmas.
These are for cross-Community Free Movement of Judgments in Uncontested Cases.
Uncontested cases include those where a duly-served defendant in a civil case doesn't turn up to the hearing.
Turkey has never turned up at the dozens and dozens of cases brought against it in the Courts of the Republic.
All that is needed for a judgment of any of the Republic's courts to be enforced in another member state is a copy of the judgment and a second piece of paper duly stamped by the court, a simple form of two pages, seeking enforcement and redress in another member state.
Well, that's the first Cat out of the Bag but there is a Second Cat which becomes effective in just under two years time. It's a Huge Cat, soooo hoooouge that CyProb, "trnc" and maybe even a part of the Turkish economy will be done and dusted when it becomes effective... and all 30 pages of it are sitting on BillC's desk-top....
