Title Deed Issue

How can we solve it? (keep it civilized)

Title Deed Issue

Postby Don Kelley » Fri Apr 20, 2012 5:43 pm

Why are so many builders, developers and solicitors in Cyprus so corrupt, why is the EU letting them get away with robbing innocent people blind regarding the 'Title Deed issue'?

I think to get some responses you should give some more details. Are you referring to a specific incident in the press, a personal experience, etc.

No specific incident just the Corrupt Builders/developers and lawyers who've been ripping people off for years, thank God (The real God, not the one that the rag paedophile Mohamed worships) the EU have taken up the issue.

Here's some food for thought...before you go and buy property somewhere, in the hope of living or holidaying long-term in the country of your choice, LEARN THE LANGUAGE and then you won't be beholden to the lawyers who say something in court that you don't understand. Get a reputable lawyer and make sure the title deeds are available and in a safe place before handing over any money!

Cyprus Needs a TOrrens Title System. These kilinjiroi make us all look bad.

Three principles of Torrens system

The Torrens system works on three principles:[1]
Mirror principle – the register (Certificate of Title) reflects (mirrors) accurately and completely the current facts about a person's title. This means that, if a person sells an estate, the new title has to be identical to the old one in terms of description of lands, except for the owner's name.
Curtain principle – one does not need to go behind the Certificate of Title as it contains all the information about the title. This means that ownership need not be proved by long complicated documents that are kept by the owner, as in the Private Conveyancing system. All of the necessary information regarding ownership is on the Certificate of Title.
Insurance principle – provides for compensation of loss if there are errors made by the Registrar of Titles.

It is quite obvious that none of you understand the current title system in Cyprus. Ski, the current title when issued, DOES reflect the facts about the persons title.
The LR register retains all the background information about the title as you do not need it on your current title.
If the LR mucks up, you can sue them for damagaes.

The problem is not getting the title in the first place due to the currently planning/registration system we have and this is main down to the dishonesty of developers/home builders to adhere to the planning rules. Thats why it is what it is.

I don't see it chanhing anytime soon as the banks/developers are too deep in shit now to do much else.
The only way is to have a bail out and start from scratch. I would be happy to head this.

I applied for the title deeds for my late father's house four years ago, despite numerous calls to my solicitor (I've done it the Cyprus way, he's my cousin's brother-in-law) I still do not have the deeds. Four years ago I nearly bought a new apartment near Larnaca, the builder put the price up after our offer so we told him to .........where the sun doesn't shine. He did us a great favour because knowing what I know now I would only buy resale with deeds. Prices are dropping like a stone, I've just been offered a brand new, 69sqm,one bed for 43k euros but I'm not interested because it does not have deeds.
