The crime was and still is committed by Turkey. It is Turkey that should be taken to whatever court you want. These people are just dumped there.iMO.
Yes, regretfully the Republic has already taken Turkey before the ECHR and despite a winning judgment in its favour, has really not got anything of real substance from it.
Also regretfully The International Court of Justice (?), which is really where some aspects of the matter should be decided isn't open to the Republic cos (as all will know and for obvious reasons) Turkey isn't obliged give a defence or to stand by any rulings from this Court.
So that would seem to leave actions on two levels against individuals.
One level might be against past and present members of the Regime and Turkish leaders for their role in a war crime; and on another level, against individual settlers and carpetbaggers for violation of the Republic's Criminal Code (as opposed to civil actions for trespass) for their part in criminal transactions involving property.
As to whether to have sympathy for any such individuals... not in the least, these are profiteers from the misery of others. Some will be members of the TA who have been rewarded for past services, the CarpetSwaggers who have bought off the back of a lorry, members of the Regime awarding themselves the choicer swag etc.
