Turkey must pay

The European Court of Human Rights Tuesday awarded 1.3 mln euros to Kostas Kalisperas for pecuniary and non-pecuniary damage, based on an ECHR judgment of 22 September 2009 on the case of “Andreas Loizou and others v. Turkey”, for the loss of their property following the Turkish invasion of Cyprus in 1974.

Kalisperas, along with a group of 28 Greek Cypriots applied to the ECHR, which subsequently ruled against Turkey, for violating the right to respect for private and family life and the home, as well as violating the right of property, on account of the applicants’ deprivation of their home and properties.

In today’s ruling, the Court also awarded 15,000 euros to the applicants jointly, which Turkey has to cover with regards to costs and expenses.

Perhaps Turkey could trade-off some military assets on their way out. :)

Not so unfortunately. Deadline for applications is 21/12/2011 and they all have to pass through the IPC first!!!

No file... was thinking more of future claims, many of which will not be property, enjoyment of property claims of the sort we have seen over the years.

We may be entering new territory...

For example at the ECHR level, Article 2 of the Fourth Protocol acknowledges citizen's right to free movement within the territory of a state. An action here would be against the Republic if it restricts free movement after Liberation Day. Potentially massive.

Here is said Article 2 in full...

ARTICLE 2

Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence.
Everyone shall be free to leave any country, including his own.
No restrictions shall be placed on the exercise of these rights other than such as are in accordance with law and are necessary in a democratic society in the interests of national security or public safety for the maintenance of 'ordre public', for the prevention of crime, for the protection of rights and freedoms of others.
The rights set forth in paragraph 1 may also be subject, in particular areas, to restrictions imposes in accordance with law and justified by the public interest in a democratic society.

Turkey will not pay and there is nothing that the ECHR can do to make Turkey accountable for her actions. The International arena has watched this situation for over three decades and have taken no action to make Turkey accountable for her invasion and occupation of Cyprus. Thus allowing the violation of human rights to continue and now we are seeing further violation of human rights by the treatment of Tc's who have spoken out against Turkey's dictatorship over the occupied areas of Cyprus.

The UN is partly responsible for this by not taking appropriate action against Turkey's continual occupation and violation of human rights.

The UK, US and Europe have not supported Cyprus as a smaller State that requires protection because it serves their needs first and foremost to have Cyprus divided and its people having to live the way they have for the past 35 years.

I don't expect that Turkey will pay the $EU15,000 or the damages awarded to each refugee that takes action against Turkey.

Unfortunately until that gas and oil start bubbling to the top and the EU sweetens its tooth by it, the Turkish occupation of Cyprus under the support of the TC community there will be no solution to the status quo.

In 2010, Turkey paid out 24,542,000 euros to comply with the ECHR's judgements - the highest amount among members of the Council of Europe, the organization of which the convention and the ECHR are a part.
