The IPC can only settle cases if they are submitted to it. The ratio that would be relevant would be number of settled cases vs number of submitted cases. I dont have the exact figure to hand but I think that ratio is in the region of 60% ish. That is 60% of the cases so far submitted have been settled.

Ok putting aside the Evkaf/Provenance of the land for the sake of discussion...

My answer has to be an unsurprising NO TO TRANSFER!

My justification must at this late hour be a bit of a work in progress, but it would prob revolve around an imbalance between the rights of Sovereign Nations and Individual Human Rights leading to an interference in the Sovereignty of the Republic that the ECHR has allowed to the Occupation Power, Turkey.

Would also argue that the "ipc" is under scrutiny by the ECHR, and contains within its constitution at least two articles, the ones which limit situations where restitution can be awarded (eg. military areas); and also conducts its business in a language other than that of the claimants... that I would like the ECHR to look at again, so yes CY is doing the right thing to to assert its Sovereignty and refuse to transfer, cos would love to see Tymvos take CY to the ECHR cos it will be a chance for the ECHR to re-examine and review the constitution and work in practise of this "ipc"

What about the IPC recognition ratio which works out to about 0.2% ? :lol:

Can not answer the question because I have no idea what the IPC's 'recongition ratio' is ? Do you mean the % of GC that could claim vs those that have claimed, assuming those that have not done so is because they as indivduals do not recognise the IPC ? If so I would say that is down to those GC and can not be blamed on the IPC.

Well after all this discussion I think we should put down some data to measure the whatever significance of the IPC and the ECHR behind it.

I started gathering information from various sources to check what is going on. Here are the results:

FIRST OF ALL:
The ECHR has set a deadline for applications until Dec 2011.

although it seems there is no other alternative than go to the IPC first before applying to ECHR some cases have already gone directly to the ECHR.
E.g the case of Lordos & Lordou. (his & her property is in the Famagusta closed area).They got $20 million for loss of use...

SECOND

there have been the following application to the IPC
100 applications in 2006
197 applications in 2007
76 applications in 2008
70 applications in 2009
341 applications in 2010
3-4 per day in 2011, 358 until 16/5/111
950 applications in 2011 ESTIMATED

Total expected:1734 applications. Compare that to the 200,000 refugees..

THIRD

There were only 2 cases concerning agreed exchange of property.
Both of them were in 2007. One of the wise guys was of course Tymbios.
I wonder who the other is.
I also wonder why we had only 2 "wise guys"

FOURTH

Thx to Erolz3 for the link to the IPC.
Taking the figures of 2007 the exchange area as such was 1,079,194 sq.meters.
Quite a lot actually but it only covered 2 cases.

FIFTH

From the cumulative data upto 12/5/11
we see that
more than half the claimed area was COMPENSATED
About 1/20th was restituted
A relatively huge chunk (about 1/8th of the total) concerning 2 cases only, was exchanged

SIXTH

Do you wonder at what average price the applicants have been compensated with??
Well look at this:
with the exception of 2007 when the average compansation was 26 STG per sq.meter
In all other years the compensation ranged from 8-11 STG per sq.meter

Compare that with the prices in the free areas where the cheapest land (agricultural land with 10% building factor) sells for 30 Euros per sq.meter
Compare that with the prices in the free areas where the average price for a building plot within town limits sells for 500 Euros per sq.meter

Those poor people who settled their properties with the IPC (actually sold them to Turkey) must have been REALLY DESPARATE.
I dont know if I should put crying or laughing emoticons here. Hmmm....

Well here are some further thoughts on the matter:

a) Why only 2 GCs got exchange land?
Simple really: Because the so called "trnc" has no other land to exchange other than some EVKAF land. On the other hand no Kibrisli (from those who have not transfered their lands to "trnc" on "echange") is that stupid to go to the IPC and exchange his land in the free areas (worthing 20 times as much) with similar land in the occupied.And this of course includes our friend Viewpoint !

b)It is obvious that the RoC has done NOTHING to help the refugees while all other Kypreos got rich on the expense of refugees.Those people who just sold out their properties in the occupied at such ridiculous prices must have been in a really desperate need. This is just an SMALL indication of HOW ROTEN THE SOCIO_ECONOMIC structure of the RoC is.

c) Given the above it seems the case of Tymbios is not of as much importance as the so many cases of Kypreos who sold out their properties for peanuts.
