Hı Kiks (our own oracle).

Do you foresee Eroglu taking 'the ungrateful' to court, acting like Erdogans puppet? Or will he 'dis-obey' Erdy, thereby endangering his seat?
Do you think he has the guts? :?

Hi Deniz,

I was intending to keep this thread discussion free and just use only "pictures", but since you asked, then I'll answer.

I think Erdogan is looking for a face saving exit from the north at some point, so he will get the TC's pissed off enough for them to tell Turkey to take a hike, so I think this is all one big play acting. Erdogan wants to join the EU as soon as possible or else if Turkey's EU chances are dead, so will be the Turkish Economy, then Erdogan might start having demonstrations for his ouster and to leave the country.

So to answer your question, I think they will take some of these "ungrateful" to court, just so to inflame the situation even more, for Eroglu looking like a puppet (is a puppet) of Turkey when Erdogan always stated that the north is a Democracy. Erdogan shouldn't really use such big words like Democracy when he doesn't know what the definition of Democracy is.

Apologies Kiks. How dare I ruin your thread. Naughty. naughty DA.

Just been to Milti. He sends his regards.

Kikapu

I kind of agree with your theory about Erdogan wanting out of the the occupied area so he is using this as a reason for the TC' to tell Turkey to exit. It is unfortunate their leader (Eroglu) is a partitionist / separatist who has not go it just yet.

My view is that ... it is sad the TC's have not realised that returning to normality under a BBF ( best option is Quebec) style an as soon as possible. The RoC is also to blame around the right of return. I think there are many options available to the RoC which they have not explored and that is voluntary compensation for those not willing to return for at least houses where TC's are currently living in. This will cover many refugees who have moved overseas and are not interested in returning r even owning a home in Cyprus any more. Espeically the 50,000 plus of Australian/ Cypriots. Who only make it to Cyprus every 7-10 years because of distance. This does not mean they loose immovable property but that the house a TC occupies uought to in many cases be separated from surounding land and allow the family to continue living in it. This covers Eroglu's point that current owners have the right to the house, this will require the RoC to do a lt of educating in the diaspora. It will also alow right of ownership to the original owner.

If may H....

... and bear with me whilst a workaround is elaborated to a point you raise. IMHO you are nearly there but there are a couple of important legal points which need covering...

Firstly, straightaway and very simply...Eroglu does not have a point in that "current owners" have a right to to "ownership" . There is only one owner, an undisputed legal owner and that is the person whose name is on the pre '74 deed or who has acquired legal ownership as per the records of the Land Registry of the Republic.

Now cast our minds back to the ruling of the ECHR last year which reminded us that there is a right to a "home" as well as a right to "ownership of property"... both points were reaffirmed by the ECHR. The ruling was lauded by some as a victory for the dodgy kochans of tnucland and the Carpetbaggers, but it wasn't, it was a victory for practically everyone in that it gives us a way of avoiding another great dislocation.

Now in much of Europe the most common way of acquiring a "home" is to rent one from a "property owner". So as H says there is a separation, but it isn't a physical line on the ground, stress that it this separation of the perfectly acceptable legal concepts of "right to a home" and "a right to ownership" .

Now to square the circle.... if we follow the ECHR's separation of "home" and "ownership of land", an awful lot of people all over CY will have to come to arrangements with owners to formalise their right to their homes.... and many, many will have to start paying market value rents for the first time in decades.
