How can we solve it? (keep it civilized)

2011 Referendum

Wondering if anyone knows more about this referendum? Will this be the final straw for unification?

The article is an extract from last year, but recently I have heard that there may be a referendum in May 2011 unfortunately I have no sources that I can point towards to support if such a referendum is to take place in May 2011.

It said 'if there was convergence on the property issue, there would be a meeting of the guarantor powers...'

The has been no convergence, we don't have nor want any guarantor powers, the TC side has demanded impossible proposals and you are pissing in the wind.

There is nothing yet to put in front of the GC community that comes any where close to a positive result.

Are they going to run a sham referendum on ethnic lines? If there is a referendum there has to be a single referendum which is not based on ethnic background.

yep... there are no Guarantor Powers... Treaty of Guarantee was def broken by at least two of them and prob by the third one... so it follows that the Treaty is Null and Void.

what the Tc are asking for is antiquated and historic ...aparteid, human rights violations a minority calling the shots, What the Gc s want is a modern forward looking country with a true democracy and protection of human rights........both sides are very far apart

Last referendum took place because (1) Accepting to have one was part of the deal of getting in EU and (2) Because we wrongly believed that Annan et al could "fill in the gaps" in the a fair way according to UN principles and deliver a decent plan.

The only case we will agree to have a referendum again is if the Turkish side accepts to put into referendum a fair plan that can be accepted by the majority of GCs. Now we are already in EU and there will be no "fill in the gaps" by others again (Fool me once, shame on you; fool me twice, shame on me).

Do you think our leadership is so stupid that will accept to have a referendum on something that will be rejected by the majority of GCs? Why would they agree to such thing?

Therefore, unless the Turkish side changes its position in a very significant way there will not be another referendum ever again.

There is only one way to prove that. Get a bunch of nutters from the south, and there is plenty of them and attack the north. If the Turks respond, that means you are wrong. If she does not then you are right.
How about it? are you conviction person or a keyboard convict. Can you lead your people to the promise land?

I can’t see the RoC ever committing to anything like this again… a sovereign UN member about to command the EU doesn’t need to… and they have gradually woken up to this fact!

Is the 1959 "Treaty of Guarantee" valid?

There are many reasons that render the "Treaty of Guarantee" invalid including the UN Charter as a result of Cyprus’ 1960 entry into the UN, but in this article we will take a look at what international law has to say regarding the termination of treaties themselves…

Vienna Convention on the Law of Treaties 1969

Vienna Convention on the Law of Treaties

Article 60: Termination or suspension of the operation of a treaty as a consequence of its breach

1. A material breach of a bilateral treaty by one of the parties entitles the other to invoke the breach as a ground for terminating the treaty or suspending its operation in whole or in part.

2. A material breach of a multilateral treaty by one of the parties entitles:
(a) the other parties by unanimous agreement to suspend the operation of the treaty in whole or in
part or to terminate it either:
(i) in the relations between themselves and the defaulting State, or

Vienna Convention on the Law of Treaties

(ii) as between all the parties;
(b) a party specially affected by the breach to invoke it as a ground for suspending the operation
of the treaty in whole or in part in the relations between itself and the defaulting State;
(c) any party other than the defaulting State to invoke the breach as a ground for suspending the operation of the treaty in whole or in part with respect to itself if the treaty is of such a character that a material breach of its provisions by one party radically changes the position of every party with respect to the further performance of its obligations under the treaty.

3. A material breach of a treaty, for the purposes of this article, consists in:
(a) a repudiation of the treaty not sanctioned by the present Convention; or
(b) the violation of a provision essential to the accomplishment of the object or purpose of the treaty.

4. The foregoing paragraphs are without prejudice to any provision in the treaty applicable in the event of a breach.

5. Paragraphs 1 to 3 do not apply to provisions relating to the protection of the human person contained in treaties of a humanitarian character, in particular to provisions prohibiting any form of reprisals against
persons protected by such treaties.


In July 1974, all three guarantor powers of the Republic of Cyprus breached the 1959 Treaty of Guarantee in the following manner…

Greece, overthrew the legitimate government of Cyprus via a military coup violating Cyprus’ government and constitution.

Turkey militarily invaded and occupied a portion of Cyprus violating Cyprus’ territorial integrity and legitimate government.

Britain, having prior knowledge of the schemes of Greece and Turkey failed to take any form of measures to protect the Republic Cyprus.

In accordance with the Vienna Convention on the Law of Treaties all three guarantor powers were in breech of the 1959 Treaty of Guarantee rendering it invalid.
