How can we solve it? (keep it civilized)

Postby revolver » Tue Oct 26, 2010 1:51 pm

EHRC Fıned Turkey with 15 millions Euros compensation about the 19 Greek Cypriots applications, the highest fine ever decided.
Now Turkey should have to pay this money, including Rock Ruby hotel owner.
Court will decide the Lordos case on November 2.

I apologize for making a similar post where more detail is given, however the question still remains: If Turkey pays, do they keep the property as if they bought it??

I wonder if by paying the these people their fair share of compensation whether the next step that Turkey has opened up is whether these people can resume their homes and live in the occupied area under the laws of the RoC no the "trnc" which is not a recognised country

Wonder if that has been debated in courts. I wonder if a Country found Guilty by the United Nations of various violation and the fact that the ECHR have recognised this violation whether such guilty party has a place in the EU the Centre from which the ECHR exists.

It is not about money, it is about scoring political points.

No, it's about justice. Whether they pay or not the ECHR has, in these cases, said you cannot throw people out of their property with impunity. They paid up in Loizidou case.

Judgments here, http://cmiskp.echr.coe.int/tkp197/porta ... on=request

Rock Ruby hotel application said, "The rent claimed was for the period dating back to January 1990 until 1 January 2003. The applicant did not claim compensation for any purported expropriation since it was still the legal owner of the property" So it looks as if the compensation was not for the property itself but loss of use etc.
