Delayed/cancelled flight - compensation

Postby Selena79 » Tue Sep 07, 2010 9:55 pm

Today afternoon the Larnaca-Vienna (and Vienna-Larnaca) flightof Blue Air was first delayed and then cancelled.

According to EU Rules the passengers are entitled to EUR 400 compensation and full refund of their ticket - unless they accepted a re-routing.

Compensation is usually paid by the airlines upon pressure. If you know someone sho would want to join the group claim, let me know.

Selena79 I had the same problem with a flight from Stanstead to Larnaca in July. The airline was Cyprus Airways and the flight was cancelled due to strikes in Greece preventing us from flying over Greek airspace. The delay lasted two days and I lost two days wages because I was supposed to return to work on Monday but eventually returned on Wednesday.

We got the same information from the Swiss Air rep so when I came back I wrote to Cyprus Airways claiming compensation. They wrote back about a month later saying the strikes were not their responsibility andso I was not entitled to any compensation so I left it at that. Should I have pressured them? What would the next step be in my case?

there is no straight yes or no answer to this question.

You may want to read about it here: http://www.bbc.co.uk/watchdog/consumer_ ... ikes.shtml

and here: http://flightmole.com/forum/showthread.php?t=1251

Personally i think that over Greece is not the only flying option so this cannot be treated as extraordinary circumstance. But knowing CA i am 100% sure that they will refuse to pay. In any case, you can file a claim with an"agent". They work on a no win - no fee basis. This is one: http://www.aeroclaim.co.uk/ClaimNow.aspx

Important is that you know that in case you did not use a ticket you are entitled to a refund AND if flight was cancelled you are entitled to compensation. In your case - you accepted the new flight, you are not entitled to refund, but you might be entitled to EUR 400 compensation depending whether strikes in another country may be considered being of "extraordinary nature". Good luck :-)
