Did this transaction take place privately as surely the new owners would have automatically gone to the Land Registry with the seller for the flat to be registered in their name. From experience, when we bought land, the owner had previously had a mortgage from the bank and the manager of that bank actually attended the Land Registry to confirm that there was then no outstanding debt.

Also, I understood that whenever the bank lent money to anybody, a guarantor had to sign a contract to make good any monies left unpaid by the borrower.

I have heard of cases where the guarantor puts all his assets into either his wife's name, or another family member's name and then claims that he has no money to pay the bank.

This is a sad situation and I do feel for these people, but I have a question.

Would they buy a property in the UK without a solicitor??? err NO! they wouldn't, so why in Cyprus?

Then, had they used a solicitor, he could have demanded a bank waiver for the property, which would have protected them from the exact situation, but saving a few quid on a lawyer has put their whole investment in jeopody.

Anyways, I hope they can come to some sort of an arrangement.
