The mortgage issue has always plagued my mind but as far as I am aware banker have mainly taken as collateral property which has equivelent in the south, so if a solution was found and the property in the north was handed back to GC owner then they could accept the collateral or sell the property in the south against the loan.

So Kifeas its not all doom and gloom but according to your opinion of me I shouldnt be saying all this as it may throw some light on how this mess may be resolved, think again....


Okay Viewpoint! Lets hope that things are as you say and let's hope that this guardian will emerge to some sensible fashion and make things look better as you say! At least I am glad you can see my point to some extend, if I interpret you correctly!

I beleive the title deeds at the occupied are of 5 different types. Quite strange for someone who lives in the RoC controlled areas and knows of only one type. Perhaps by their nature at least 3 out of those 5 types of deeds could be put under a Guardian, but i really don't know the details or the facts to tell.

From the examples given by Erol it seems he would prefer the Guardian to be sort of a Manager of a property without the consent of the owner. Such arrangement cannot stand legally though.I leave aside the fact it will not change anything from the existing situation.

All the Guardian can do is just protect the property from anauthorised use.He cannot develop it, he cannot let anyone built on it or change it.Furthermore he has no obligation to carry maintenance on it, nor use tax payers money to do so.

If the doctrine of necessity needs to apply to the occupied to assure an economic going then this economic development should be done on No 1 type of properties ONLY, i.e guaranteed TC ownership prior to 1974.

PS.Turkey is now getting into the EU.Turkeys interests started been affected.Turkey ordered to change the law. The next step:Turkey will order to disolve the Trnc and return to the RoC status (presumably that of 1963).
