Turkey sued in Cypriot courts

How can we solve it? (keep it civilized)

Postby BirKibrisli » Fri Mar 19, 2010 3:27 am

Since we have decided to solve Cyproblem in courts,I am sure there must be some international court or UN council Turkey can apply to get the RoC declared illegitimate... :)

After all, they have been operating in violation of their Constitution and the 1960 Treaties since 1963...Just a thought...

how can that be when the Tc voluntarily withdrew from the ROC government and wanted their own entity only 4 years after signing the Zurich agreements....In actuality the Tc are in violation

Not everybody in the South seems delighted with this latest development!

From the Cyprus Mail today ..

Regarding the Shacolas Group suing Turkey in a Cyprus court, Christofias said when he heard this “my hair stood on end”.

“I am very afraid we will have another (legal) boomerang,” he said, noting that the poor would not be found in court. “To say the truth, it is the haves and the have-a-lots that make appeals. Unfortunately, at some point we should restrain ourselves a little.”

It couldn't happen to a better person. Just as well it didn't happen to Talat with his follically challenged condition, what?

More from the school of "if Turkey was bad Cyprus was worse" , "shoe on the other foot" "see it from my side" and "two to tango" school of deluded miss philosophy!

Justice doesn't work that way. Not everyone is guilty just because someone (you!) did something wrong.

Go ahead; maybe only then would you come to realise we did nothing more than defend ourselves, our country and our people who your people have set about destroying for centuries and to this day impose a racist apartheid regime to keep the native aboriginal peoples from their lands of generations.

Yup, take that to the courts! Give the judges a laugh ...

As some wise person once said, those who live by their Might need many allies; but those who live by virtue only need Justice!

... and no doubt Pres X's hair went white.

Why does he make the claim that the Courts are the preserve of the wealthy? With the the benefit of the precedent-setting Mr A v The O's it'll be easier and cheaper with each successive case.

After all what does it cost to ask a Nicosia Court for a summons and a Judgment in Default when Turkey doesn't show to defend the action?

After a little reflection, I will stick with my gut reaction and say this appears to have the makings of an incredibly destructive move. I got the Varosha line, but this line really is going to be a big headache. When you think what must happen for RoC courts to have another EU country seize the assets of Turkey when there is a remedy via the ECHR path established, the agreed framework of BBF etc, it doesn't look so smart in the cold light of day.

For all I know Christofias is lying with what he stated about the case, but I would tend to consider the impact of the case to likely be an own goal as quite feasible.

Just my thoughts, no insinuations about what's right or wrong. I am not a lawyer so perhaps the legal channels will get the decision they want, but as we all know in Cyprus it's not about who's right or wrong (both sides lie), it's whether you can get away with it and at what cost, and if not, at what cost.
