Divorce

Postby Svetlana » Fri Mar 12, 2010 5:53 am

I know a lawyer can give a definitive answer but I would welcome people's input on the following in Cyprus:

What are the procedures and timescale for an uncontested divorce?

If the divorce is contested but there are no immediate grounds (infidelity, violence etc.) how long does the plaintiff have to wait for the divorce to go through?

Now a tricky one: if a non-EU national is divorced by their EU National husband, do they lose their Right to Residency?

All questions on behalf of a friend, of course!

I know someone who got his divorce through in two weeks. His lawyer was a good friend of his and managed to move it along quickly. The non-EU national would definitely have problems even if they had been living legally in the Republic for more than 5 years.

It is still best to ask a lawyer.

The answer to the residency question is simple . Marry an EU national while the divorce papers are being printed !!
I know a lady from the Ukraine who did just that !!!

Lana, in Cyprus we have two types of divorces… “religious” and “town hall”.

The latter is very easy to get but for the first the church must have one of the two persons either admit or be proven guilty of infidelity, abuse, etc. The procedure can take as long as 3 years.

I had a religious divorce 6-7 years ago and at the advice of a friend priest I stood up and “admitted” infidelity even though I never did it, just to get things done because I didn’t want to waste any more of my time with that stupid woman!

Btw, living under separate roofs for several years (and in my case different countries even) is still not enough ground for them to give you a religious divorce believe it or not, so keep that in mind.

Do you actually need a religious divorce? :?

Even if you get remarried, it's only the civil ceremony which decides whether you have committed bigamy.

Much easier to just say you don't believe in God any more and hence self-annul the religious part! :D
