You are making a very big mistake, saurkraut. The two cases /issues have nothing to do with each other. Learn the merits of each issue, and then talk. The GCs can still go after individual trespassers in RoC courts and can still enforce such decisions in all EU countries, and no EU national court has the right to refuse enrolling and enforcing such decisions on the basis of the IPC's existence. Learn the facts. The Orams example pertains to EU law, and this has become a closed deal now, after the ECJ decision, whereas the ECHR decision on the IPC pertains to human rights violations by a country member of the CoE (Turkey,) under which the ECHR functions. Facts regarding the Orams example /case remain exactly the same, as they used to be before today's ECHR decision on the IPC. In fact, now there will be a hell a lot of more legal action in RoC courts against individual trespassing, since the door of the ECHR has somewhat been closed for GCs, before going first through the IPC.
