No. The people who captured him were civilians whose relatives he had been Napalming earlier. They were acting in self-defence.
Besides, he was in direct violation of the Geneva convention:

Hi Bill and DTA,
The above photograph depicts 4 CNG reservists captured by the Turkish Army. What the photograph does not depict is that there were actually 5 POWs in company. The 5 POWs are:
As you all know, these photographs were taken by a Turkish journalist. The 5 POWs were treated exceptionally well due to the presence of this journalist. They were all given cigarettes, a luxury item for any soldier in the field on rations, so that the journalist can have his photographic opportunity. These particular photos were also published on many mainstream Turkish media outlets, depicting Turkish soldiers given these CNG POWs their final cigarette. The Turkish Army was exceptionally nice to shout these POWs their final cigarette!
This particular photograph is the most gruesome and painful. As you can see, the POWs are by themselves and the Turkish Army APCs are about to depart for Famagusta. Please note that there are also some GC civilians on one of the Turkish APCs. The CNG POWs were never seen again!
The remains of the 5 CNG POWs have been found by the Committee of Missing Persons. They were all given a State funeral.
The 5 POWs were captured near the highway to Famagusta. The were firing on Turkish Armour as they were advancing towards Famagusta, thus giving away their position. Inevitably, the men were captured!
The 5 reservists never attacked any TCs, as some one had suggested.
As I said earlier, these events remain in the past. It is time to look towards the future and a United Cyprus. I don't want the memory of these men to be abused in any way.
These 5 POWs would want nothing more than a United Cyprus where all citizens are equal. If they are looking down upon us mortals, they will be wishing that none of us, GC or TC, will never have to suffer the way they did. They will wish peace upon us all!
It is with some emotion I write this post. As I am tired, I will wish you all a very good night, and I hope all off you show some respect to these POWs smoking their last cigarette!
