With thanks to Bill Cobett for having brought to all our attention the availability of a webcast from the ECHR of the Cyprus proceedings against Turkey on 18th November, these being a very important part of our history these videos do need to be viewed by all of us.

Some very interesting points emerge as I skim briefly through these videos. They are definitely worth spending some time over; so thanks for compiling them grokked.

Turk-TC forumers here have repeatedly accused GCs of racism when what actually overwhelmingly surmises from these hearings is the specific racist attack a state (Turkey) has systematically undertaken against anyone Greek or of Greek name or of Greek ancestry!

[Take note those who want to view themselves as simply "Cypriots" under such a climate as we have of Turkey's ethnic cleansing specifically of "Greek" Cypriots. This is the GC refugee's greatest defence against Turkey's racist crime. The fact GCs were specifically ethnically cleansed because they are non-Muslim and Greek. It will hopefully be Turkey's undoing to have so clearly violated the most fundamental of Human Rights.]

The other point was the fact that GC refugees are under no obligation to seek compensation through the "TRNC" property commission because it is wholly ineffective. They were under no obligations to exhaust even all effective remedies, let alone consult one proven to be ineffective.

There are many interesting facts emerging as the evidence is heard ...

Thanks for the comment Oracle.

The subject matter of the hearing (whether the ECHR can lawfully and validly refer the thousands of cases outstanding against Turkey to the IPC and so unclog its own caseload against one of its worst-offending nations Turkey, which they had originally hoped would 'get settled' as the Annan Plan had proposed) as well as the fact that the hearing was held in 'Grand Chamber', meaning 19 judges rather than the more usual 7; the timing now after those many years of waiting in combination with the many judgements issued by the ECHR during September which were highlighted for us in another thread ( http://www.cyprus-forum.com/cyprus27440.html ) by GetReal -- these are all significant factors which I believe bring great pressure to bear on the Turkish Governent to allow a solution of the Cyprus problem.

I hope that Forum contributor Copperline, who contributed so much to our appreciation of the significance and legal nuances of the Apostolides vs. Oramd case in the excellent reporting by Bill Cobbett and Jerry in their reporting on that case ( http://www.cyprus-forum.com/cyprus27312.html ), and other legal boffins on this forum will provide us with the benefit of their analysis on this thread also.

At a time when there is scant English-language reporting and analysis of the Cyprus Problem from the perspective of the Republc of Cyprus, other than the bias-laden reports by the the Cyprus Mail and the brave but meagre reporting but no analysis in the Famagusta Gazette - the case outlined in English against Turkey in the videos of the ECHR is one of few to be found and which led me to making the material available in this manner as my own contribution to 'enlightenment'.

The second video, Michael Anderson, is a model of clarity and legal reasoning.

Both Turkey, but especially the TRNC authorities, need to take a long hard look (listen) at Anderson's reasoning because this summarises the general and continuing violations which TRNC must deal with. It cannot pretend that these are not the issues. Whilst TCs may have different proposals for resolution of the problems - this is perfectly reaosnable and proper - it cannot do so on the basis of ignoring the issues.
