Any lawyers here...?

Postby Svetlana » Thu Jul 16, 2009 6:57 am

A friend was stopped by the Police, last evening; her licence, insurance and Work Permit/Visa were all in order, but the police noticed that a man in the back seat did not have his seat belt on. Neither did the girl next to him, but they ignored her!!!

The guy was given a €64 fine, which he has said he will not pay. If this happens, my friend believes, that as driver of the car, she will have to go to Court.

Does anyone know if, in Cyprus, a driver is responsible in law for ensuring his passengers wear seat belts?

Thanks

Lana

As far as I know the driver is responsible for a front seat passenger, rear seat passengers are responsible for themselves. That is why they got the fine. However, if the bloke doesn't pay it and it goes to court, your friend might be called as a witness I suppose.

From what i know they can charge the driver only when the passengers are not adults. But even if there is any secondary legislation which provide the option to charge the driver for allowing the passenger at the back to wear a belt its no something you should afraid of!

Not a Lawyer, but think he got off lucky, he in effect is a human missile in a car without a belt   No doubt he will recieve points on his licence too? If he was seated behind the driver and the worst happened he/she could be dead after he smacked into her as he continues onwards.

I would,nt get in a car with a driver who has been drinking, likewise I check on everyone in mine has their belts on, as I don,t want this happening to me

Actual happening in Ireland re-enacted for the shock that ALL seatbelt wearers would have been alive or not brain damaged had the guy worn his seatbelt too in the back.

This just sums up the typical Cyprus attitude to the traffic laws and regulations.

Everyone knows that it's the law to put seat belts on when traveling in a car but some choose to ignore it.

Just the same when a traffic light is at red, it means stop but how often do you see this ignored as well?

All the time, especially at pedestrian crossings. As soon as there is no one on the crossing and the light is still red you get tooted if you do not go, even though in every country apart from Cyprus RED MEANS STOP.

To be fair, Geoff, the people concerned were not Cypriot but Sri Lankan and were driving one of my cars - and I am unCypriot too! So yes, attitudes in Cyprus - but not only by Cypriots.

Maybe, I will end in Jail :-(

Actually Geoff its not just Cyprus in fact a classic very high profile case of no seat belt wearing at high speed where Trevor Rhys Jones survived wearing one, was in Paris. I met Trevor a few times long after the event as he married someone I knew from Shropshire, he talked to very few about that accident, as he knew he needed to get away from it, but it stuck in my mind that he mentioned that he would,nt be here without his belt, and tried at the time to get others to belt up as well  :(

Why do you worry then ? since you are the owner and not the driver you have nothing to be afraid of..you could end up with a fine only if the driver was driving without the necessary certifications (f.i. without insurance cover or driving license). The fine will be sent to the adress that the passenger gave to the police.. if the fine remain unpaid police will sent the case to court and if they dont find him to service the churge it will be withdraw..if they service him the churge and he wont appear to court they will give him a bigger fine(probably three times bigger than the initial one) at his absence (since such kind of ofence-minor ones- can be proved to the absence of the accused and then police will try to collect it(if they ever find him!!). And if they were supposed to churge the driver they should give her a fine the same time they noticed the offence so if they didnt last night..

Here we go again, Mr. Smartarse Anti-Cypriot Geoff jumping to conclusions. As if no one in England or anywhere else in the world has been booked by the police for not wearing a seatbelt or jumping lights or even drink driving. Only the Cypriots do this. Are we unique or what??!! :)
