ECHR to decide on property ‘commission’
The full bench of the European Court of Human Rights is to decide on the status of the so-called property commission in the occupied areas, after the seven-judge panel of the Court waved jurisdiction in favour of the 17-judge Grand Chamber regarding eight pilot cases pending before it.
The Strasbourg-based Court in late March notified the eight Greek Cypriot applicants and the respondent Turkish government accordingly and in the absence of any objection the transfer was finalised this week.
Nicosia lawyer Achilleas Demetriades who handles two of the cases described the development as very important.
“I consider this a very important development, because it shows how seriously the Court is taking the issue of effectiveness of the “commission” set up by Turkey,” he told The Cyprus Weekly.
As he explained, the outcome of these cases will determine whether Greek Cypriot refugees will continue to take Turkey to the ECHR for the violation of their human rights or will be obliged to apply first to the so-called “commission” as a local remedy.
Demetriades stressed that the applicants considered the “commission” mechanism as ineffective and violating their human rights.
He said the next step is for the Grand Chamber to meet and issue directions to the parties, before setting a date for the hearing.
