'Unjust' flights ban challenged
A ban on direct flights between UK airports and Northern Cyprus comes under challenge at the High Court.
The ban has lasted 35 years and been criticised for causing "considerable inconvenience" for travellers.
The legal challenge is being brought by Cyprus Turkish Airlines (CTA), which flies about 100,000 visitors from the UK to Northern Cyprus each year, and its UK tour operator, CTA Holidays Limited. They are seeking to overturn the UK Government's "unlawful and unjust" refusal to lift the ban.
Any chance of this succeeding?
The High Court has absolutely no jurisdiction over this matter and neither does the UK Government or its Civil Aviation Authority.
The UK, Cyprus and Turkey are signatories to
The Chicago Convention and as a result the UK or any other country that is a signatory to the Chicago Convention will not be allowed to lift any bans to declared illegal ports of entry as announced by the
Civil Aviation Department of Cyprus. It is
impossible for any ICAO member state to disobey another ICAO member state in territory which is
legally under its jurisdiction, even though it is not under its direct control for the time being at least.
The only authority that can permit direct flights to "ERCAN" is the RoC, and that wil
never occur under the present circumstances.
