Courts do not make policies, let alone a political one. They only interpret the law in any given case, so don't look for miracles to happen in the UK courts.

Why are you so concern all of a sudden regarding this ruling by the ECJ.? Did you not tell us it was not worth the toilet paper it was written on and that it did not mean shit.!

Dear Mr X

I am writing to you concerning the recent judgment of the European Court of Justice in the case of Apostolides v Orams C-420/07.

I refer you to the following urls concerning the full judgment of the European Court and a press release summary concerning the same.

http://www.bailii.org/eu/cases/EUECJ/2009/C42007.html

http://curia.europa.eu/en/actu/communiq ... 0039en.pdf

This ruling has serious implications for anyone in a Member State who purchases land and/or property in the northern Turkish occupied region of the island of Cyprus. The Court held that the Orams, a British couple who had purchased land in the northern occupied region from a third party to construct a holiday home, must abide by the ruling of the Court in Nicosia to demolish the property and pay compensation to the rightful owner, Mr Apostolides inter alia. Significantly, this ruling must be recognised and enforced by EU Member States, even though it concerns land situated in the northern part of the island over which the Republic of Cyprus has limited effective control.

The judgment forms part of a long running campaign for justice on the island where in 1974 around 200,000 Greek Cypriots were forcibly expelled from their properties and made to settle in the southern part of the island. This dispossession is still being maintained by the military force of Turkey and its illegal occupying regime on the island, which still refuses to cede the property and land to its rightful owners, and have instead illegally allowed immigration and property sales to further entrench the status quo.

I would be grateful if you could raise awareness of this matter in the House of Commons and anywhere else you see fit, and also pursue such avenues that in your opinion would promote a resolution to this unjust situation that has been ongoing for 35 years.

Yours sincerely,

x

Can you also include that this is the most irresponsible act which will cause greater hardship to the TCs then they have already suffered thus far and also may make peace impossible and may even lead to war with 10s of thousands being killed.

I think that will put your MP in the picture.

Fred you do surprise me mate. Why on earth should an act by the ECJ be seen by you as an "irresponsible" act . I thought you were far more intense than dismissing this monumental decision which will affect all decent law abiding Cypriots . Why should a decision that supports justice be " irresponsible " , what logic has determined that the LEGAL owner of the land on which unscroupulous Brits have built their villa is "irresponsible"

The T/Cs are also the victims of the illegal occupation and the illegal acts that took place and are still taking place.
Why do you think that this decision would encourage "war "
This decision has supported all that is decent and correct.

Do you realise this gives the biased GC courts a free hand to churn out decision as they see fit and have them carried out by EU member states? where will you be when the first TC residing in the UK is prosecuted and your discriminative courts rule their business in the UK is closed down?

Lets hope that the Brits have seen the implications and use a few words of caution linking action to a comprehensive solution this may then encourage GCs to work more positively towards compromise and really desiring a solution.

VP, if I were you, I would have avoided talking about the ruling and see instead what I can do towards a solution. I suppose you will realize this pretty soon, when you get the time to reflect on the verdict of the ECJ and what it means.

I think we have to counter and show GCs that these actions only harden the view of even the most tollerant TC, which in turn does nothing to help find an overall solution. The TCs are moving closer and closer to official union with Turkey, how would the GCs feel then? come claim your land which is now officially part of the country your GCs love and admire so much Turkey.

Its toilet paper if the Brits do add a twist to the verdict or somehow link enforcement to an overall solution or its delayed in the Lords, but in the meantime we have to think of ways to couter and show GCs that this sort of action will make things worse for GCs.

I’m very curious to learn just how much “closer” Turkish Cypriots can possibly get with Turkey given that they’ve already done the full anal…

On the contrary, this judgement makes a solution more likely as there is now greater clarity over the property issue. Christofias cannot go against the ECJ decision. It is not in his power to negotiate away the property rights of the original legal owners. It never was.

Of course it will take time for the implications in the north to sink in. But if anything it will encourage the negotiations rather than bring them to an end. For those in the north who thought that they could just go it alone, it is a reminder that they need a settlement otherwise they face an uncertain future and continued illegality and pariah status in the eyes of the world community.

Right, so Turkey shows up one day at an EU meeting and says… “Just to let you guys know that we hereby officially announce our annexation of territory belonging to one of your member states… namely Cyprus!”

And then Barroso gets up, starts a standing ovation and offers Malta too!

Am I on the right track VP? :?

This decision has supported all that is decent and correct.

Very simple, the court that passes judgement on GC properties at the same time blocks TC cases saying that their case cannot settle until the agreement. This is injustice of the worst kind. Its racist and the most indecent action ever. Its just goes to prove that International Law is an ass.

Just stop for a moment and analyse it for what it is. This poor TC has been given a piece of land for the land that he has in the south. He waited for 30 years and decided to sell it. Do you blame him? How is this theft? This man’s land is being used by a GC as we speak. This is the most hypocritical situation and although I can understand the reaction of your more extreme elements, I find your reaction incredible.

Why war? If the hawks come to power in Turkey too, anything is possible.

The day RoC stops being racist and treats TCs equal in the eyes of the law, I will be right by your side, till that day arrives, I cannot join you.

RoC police and the justice system leave a hell of a lot to be desired.

Unless of course the first fight is to accomplish the above, and then I am with you.
