I understand most of that land is legally owned by a GC, who, of course, never gave permission for such use of their property.
Tymbou, the real name of that place, and all surrounding areas were 100% Greek Cypriot owned. I happen to be one of the owners of land there.
GR, I hope it did not escape your notice that in my post "Ercan" is within quotation marks. I am (partially) aware of the situation in the Tymbou area. Most of it has been flattened out by the turkish miltary, I gather.
Unfortunately, I was able to observe via Google Earth, that our house and all the neighboring ones are no more. In fact most of the village has been flattened in total disrespect of my childhood, my ancestors, …our dead.
We do NOT forget…
You should contact Achilleas Dimitriades and file a case within the ECHR if you have not done so already.
It takes a minimum of five years and you have to exhaust all local remedies first. WIth the fresh developments of today it might be better to go after a civil suit in Nicosia against them. We're looking into it for our land in Morphou and Kyrenia.
I had no idea about this.
My in laws filed in 2000 and the case has now progressed and a hearing is now imminent.
When they filed they did not have to exhaust any local remedies.
But still, if the person that is illegally using your property has assets in any EU country, you would have a field day...
they filed before the cut-off point which was 2003 or 4 if i remember correctly. Everyone filing after that must exhaust local remedies.
That makes sense. Come to think of it they did mention a cut off point.
But why didn't you guys file when you had the chance?
If I were you, I would definitely file a case in Cyprus and then see how you can go with taking it to ECJ and ECHR.
Contact Achilleas Dimitriades for legal advice at once.
But don't go anywhere near the "trnc" property commission..
I know Achilleas very well, have spoken about it many times...we'll see how this pans out.
