“From 12 December 2008, an additional debt recovery option will be open to a party owed money by a party in another European Member State.
The new European order for payment (“EOP”) procedure, prescribed by Council Regulation 1896/2006 (“the Regulation”), will speed up and reduce the costs of litigation in cross-border cases concerning claims for a specific amount. (The Regulation does not specify any upper financial limit.) It can be used in civil and commercial matters but there are a number of specific areas to which the EOP procedure will not apply. The most significant exception in the current economic climate is insolvency-related matters.”
