European arrest warrant replaces extradition between EU Member States

"A European Arrest Warrant, valid throughout the European Union has replaced extradition procedures between Member States of the enlarged Europe. Such a warrant may be issued by a national issuing judicial authority if the person whose return is sought is accused of an offence for which the maximum period of the penalty is at least a year in prison, or if he or she has been sentenced to a prison term of at least four months. A decision by the judicial authority of a member state to require the arrest and return of a person should therefore be executed as quickly and as easily as possible in the other Member States of the European Union. The European Arrest Warrant means faster and simpler surrender procedures and no more political involvement. It also means that Member States can no longer refuse to surrender to another Member State their own citizens who have committed a serious crime, or who are suspected of having committed such a crime in another EU country, on the ground that they are nationals. Simplifying and improving the surrendering procedure between EU Member States was made possible by a high level of mutual trust and cooperation between countries who share the same highly demanding conception of the rule of law."

No safe havens for criminals in European Union

"The European Union is replacing lengthy extradition procedures with a new efficient way of bringingback suspected criminals who have absconded abroad and for people convicted of a serious crimewho have fled the country. Theoretically; could the ROC High Court issue an EAW for contempt of a court ruling and have it served in another EU country?

yes, recent case of the 3 English guys who killed the Cypriot kid on a motorbike is a good example. Cypriot court found them quilty after an appeal and a sentence was passed. They refused to show up and were issued with an EAW which was executed in the UK. UK court ruled that they had to be flown back to Cyprus.

On the same lines then, people in the north of Cyprus who have a court case awarded against them by the ROC courts could have an EAW served against them in any EU member country if they fail to comply with the rulings of the court and then they would be flown back to the ROC. I think if I lived in the North I would be a very worried person even when not taking into consideration the upcoming Orams case.
