The illegality rhetoric

The illegality rhetoric

Postby LANDJO » Tue May 31, 2005 2:02 pm

This is a continuation of the string on the TRNC flag, which has turned into something different, so please forgive me for opening a new string to voice my questions.

As, believe it or not, a foreigner and a self-proclaimed 'neutral' on the Cyprus problem, I would like the GC's in the forum to explain further the reasoning behing the illegality rhetoric. Both in terms of what you personally think, and in terms of what the government policy is.

I understand that TRNC and its flag are illegal. I also understand that all public offices in the North are illegal. including, of course, the title deeds they issue. But the more I think about this situation, the more ludicrous the consequences are. In theory, the RoC could punish me for any kind of interaction with the government...

- paying a fine for speeding in the North
- visiting a hospital
- passing the 'border' and showing my passport
- using a TRNC driver's license
- using a TRNC registered car (especially in the South)

Obviously, the law is not implemented in these cases. But what I do not understand is: why implement the law when it comes to property or flags, but not here? If the RoC says that TRNC is illegal in theory, but that it is countenanced for practical purposes only, that is one thing. But it isn't.

What do you think?

Do you know that RoC has been suppling the occupied areas with electricity for FREE for decades?

RoC doesn't want to harm the Turkish Cypriots because many of them might not have an alternative and they are just victims of the occupation like us.

Therefore RoC is trying to tolerate us much as possible any illegalities that will not have a signifigant negative impact on the future.

However the illegalities that have as an aim the cementing of this illegal situation and the partition can not be tolerated.

This is also the answer to those that say that RoC is trying to hurt TCs. No. RoC tolerates the illegalities of TCs as much as possible, and it is sad that TCs do not appreciate this.

I have read though can not confirm that the RoC does not supply any electricity to the north (free or otherwise) any more and has not done so since 94. Also there is a brief mention of this electricity from the RoC in David Carters book 'The Cyprus Tapes' In the chapter 'Blackout at the dome'. A breif extract a quote below.

"Aug 78

Barely had those words left his lips when the hotel lights went out. They were left in absolute blackness, and so was the rest of Kyrenia. Not a single light could be seen anywhere.
'do not worry,Madam.' Fikri said, his voice a mixture of irritation and concern. 'The Greeks have cut off the electricity again'

And yet you constantly remind us that we can only get away with these illegalites because of the balance of power and Turkish tanks and that when this balance changes we will reap out due reward unless we agree to your terms now. So what is it? Do you 'tollerate' these 'illegalites' because of your love and compassion for TC or is the reality closer to you 'tollerate' them because you have no effective means of stopping them? Is it love or impotance? If you had the means to force an end to the 'illegalites' would you use it or not?

This is what I was talking about. Gave them free electricity for decades and instead of appreciating they complain!! And by the way, I am sure that if the electricity problem was in the occupied areas you would still blame the GCs for it.

And yet you constantly remind us that we can only get away with these illegalities because of the balance of power and Turkish tanks and that when this balance changes we will reap out due reward unless we agree to your terms now. Both.
RoC can not stop the illegalities that happen in occupied areas because the Turkish army enforces the illegality.

However RoC could arrest TCs entering the land controlled by RoC or even issue arrest warrants that would be valid anywhere in Europe. RoC doesn't do that, and in this case it is because it doesn't want (for the reasons I wrote in previews post) and not because it can't.

Yes, if it was up to me, neither Cyprus nor Greece would be so soft towards TCs and especially Turkey. I hope that the Cyprus and Greek governments will see how Turks do not appreciate anything and change their stance accordingly.

Not without being in direct (illegal) breach of agreements solemly entered into with the EU.

it is extremely unlikely that you will even be able to get the european arrest warrants already issued for people illegaly (under RoC law) exploting former GC land executed in any EU country. EU arrest warrants can only be issued for crimes that have a possible sentance of 2 years imprisonment for the crime in the country issuing them (and that's just the first hurdle in such use of these warrants) - which is why you changed the law on the exploitation of former GC properties in the north and why you could not issue EU arrest warrants for people breaching the RoC law on entering and exiting Cyprus via a port of illegal entry (a law that your own courts are telling you can not be enforce even in the RoC - let alone in the EU via EU arest warrants) even if you wanted to. You could change the penalties for the law on illegal entry or exit but even then this law would still be unenforceable even in the RoC because of the agreements you have made with the EU.

It does not do that because it can not do that legaly under its own / EU laws and because it could not do it politicaly - and not out of concern and compassion for TC community as you would have us believe.

landjo

you asked in a previous thread why tc failed to get their voices heard.
ive been thinking about that one and can not find a decent answer.

perhaps i might throw your question back at you and ask why the world never listened when we did voice ourselves?

As for this is legal and that isnt legal........................hey man welcome to Cyprus...........................one law for this, another for that, one for them, another for the other lot.......blah blah.

Please do us a favour and tell them back in your homeland the nonsense that goes on here.

Don't worry, I am sure the goverments of both Cyprus and Greece will do what they can in fact do, when they realize that Turks do not understand from soft policies and trying to be nice to them is useless.

exploting former GC land

former????

Anyways, what did we expect from uncivilized barbarians that know nothing more than stealing what others created.
