Brothel suspects lose warrant appeal

THE SUPREME Court has rejected an appeal by a couple charged with maintaining a brothel, who sought to deem the relevant search warrant illegal.

The 30-year-old Russian actress and her 40-year-old Cypriot husband were both arrested in early August after police raided their home and found evidence indicating that they were allegedly operating a brothel out of their home.

The couple, who are facing charges of pimping, maintaining a brothel and profiting from prostitution, filed an appeal to the Supreme Court requesting a cancellation of the search warrant on their flat. Their claim, among others, was that the warrant contained no safety clauses against possible abuse by the police.

They said the police should have given a clear description of the objects they were seeking to find.

During the search, police had found hidden cameras and sexual depictions on a computer’s hard disc, which were confiscated to be used as evidence in court.

The Supreme Court heard that in order to acquire the warrant, the police told the specific judge that there was information that a massage institute in Nicosia was being used as a brothel and a specific masseuse was being pimped by the two suspects.

The judge issued the warrant.

The Supreme Court judge decided: “The search warrant was issued in accordance with the law. The specification in the warrant of the objects that were expected to be found during the search, meaning that these were related to the specific crime of prostitution, was enough and there was no need for the police to specifically name the objects they were hoping to find.”

Going a step further, the judge added, “At first view, it appears the objects found are connected to the crime of prostitution, for which the warrant was issued. If these objects vilify the applicants or not, this is a matter for the Criminal Court”.
