I will try to reply in a civilised way not like some people on this forum.
With due respect your arguments are very weak indeed. You refer to the constitution of 1960 which does not allow the creation of another state within another state. If you recognise the TRNC as a seperate state then defacto you cannot fall in within the legal protection of the 1960 constitution.

Ceasefire line - if this is correct then it is a ceasefire line within the Cyprus republic and therefore north of the ceasefire line is still within the republic and hence the TRNC is illegal.

Point 2 - is irrelevant to the discussion .
Point 3 - Annan plan had no legal binding
Point 4 - Un proposal is a proposal for now
Point 5 - You may have a point on this one but the fact of the matter is that it is the Republic of Cyprus that was formally admitted to the EU and that includes yourselves.

Therefore if you recognise the 1960 constitution you automatically recognise the EU admission of Cyprus and relinquish your claims to the TRNC.

Thank you for your response. Even though, as being a Turkish Cypriot (naturally) at odds with most of the subject areas of Cyprus with the Greek Cypriots, your courteous manner and polite attitude, so far, I hope, could set an example for meaningful communication(s) on this forum. This forum could be a unique platform for discussion if those who do not wish to discuss the Cyprus issue in a polite way were removed - or at least warned!

Here's my Response to your post: I'll answer it in point form if you don't mind:-

1. The TRNC actually NOT being recognised serves Turkish policy on the Cyprus issue[/b] as it can Pick and Chose when it wishes to support the recognition of Northern Cyprus (a breakaway Turkish Cypriot State) at the same time as Completely Supporting a BBF UNITED NATIONS plan.

2. The EUROPEAN UNION accepted the Entire Island as an EU member state regardless of the cease-fire line, and regardless of its "Internal" political situation! Therefore, and ultimately, our efforts in striving for a negotiated Cyprus agreement is actually an Internal matter, where the EU (evidently) prefers NOT to interfere with! (This is the GC's biggest problem).

3. If the Greek Cypriots want to remove the cease-fire line and unite with Northern Cyprus (“a break away state supported by Turkey” - Reuters), it can only do so as part of a UNITED NATIONS settlement plan of a BBF as agreed by Denktas and Makarios - high level agreements. This is the general consensus by most external mediators involved with the Cyprus issue.
Therefore, Turkey's 1960 rights on the ROC remain solid. More Simply put, the Greek Cypriot Controlled ROC of today is not the Final ROC that will ultimately materialise - as how many people who live in the GC Controlled area wrongly assume! If what the GCs believe is a reality, then why are they, and have been, politically locked in a “UN” based negotiating process (since 1963!)? Why not just simply say (because they legally can not) that the GC Controlled/Administered ROC IS the final solution and that no other solution is required? Because, the world recognises the fact that Cyprus is an island locked in Conflict (that the clear evidence of its bloody history is valid), where they recognise the Turkish Cypriot call for a negotiated Federal settlement based on a BBF formula (High level agreements), and where they accept that the GC Controlled ROC only represents the half of the island of Cyprus as a Temporary fix to the problem (View the CIA Country FACT website for Cyprus – Referencing to both Turkish Cypriot Administered and Greek Cypriot Administered areas).

4. Turkey's so-called "Occupation" of Northern Cyprus is only (also) a "Temporary" situation it is fully aware of and has stated many times in the past of its willingness to withdraw only as part of an OVERALL UN Settlement Plan; similarly to the plan agreed by the Turkish Cypriots in April 2004. Also, as Turkey has not annexed Northern Cyprus to date, it is NOT seen as an invader and Occupier by the UNITED NATIONS - otherwise, Turkey would have been politically forced-out, Right?

5. Until Turkey becomes a FULL EU member state, or if the EU should give Turkey's an Ultimatum (which I highly doubt, but will not completely rule it out), Turkey can continue with its support of the TRNC under the Call of the Turkish Cypriot partner peoples of Cyprus.

6. In my view, the island of Cyprus only has Two Fundamental Choices: Firstly, is to accept a UN sponsored BBF Plan, and then work with Turkey in becoming a Full EU member state, or rejecting all works by the UN to unify the island and wait until the End of Turkey's EU membership process (or until deadlock) and suffer the consequences - And we know how weak the EU is at coping with disastrous cases (Yugoslavia etc).

7. In Conclusion, as the TRNC is not internationally recognised, as the Turkish Cypriot and Turkey are more than willing to agree to a UN Sponsored Federal plan and as Turkey is ready to recognised Today’s' ROC (as a UNITED or Federal ROC) (an dissolve the TRNC in place of a Federated Turkish Cypriot State) if a UN plan is signed and sealed, I would say that the Greek Cypriots are in a very difficult position (as they clearly appear to not want to relinquish their stealth power/representation on the current GC Controlled ROC). Either they (GCs) defy the UN completely and persuade the EU to push Turkey for a Solution to the Cyprus Problem without the UN (impossible I must say!), or accept partition of the Island - which, I am also not completely convinced that Turkey would accept that idea as, and if I am not mistaken, I am certain Turkey would much prefer Cyprus to become a BBF with a loose Central Government!

So there we have it, two “Temporary” Cypriot areas – the GC Controlled ROC and the TRNC, ultimately destined for either unifying under one roof under a BBF, two Federated State, Loose Central government, or Agreed Partition – Only the future will decide!!!

Here below is my reply to your post.

Under International Law the only recognised legitimate state in Cyprus is the Republic Of Cyprus as established under the constitution of 1960 and includes 100% of the Cypriot territory including the " occupied territories" of the TRNC. So under international law you are living under the Republic of Cyprus.

The TRNC does not exist in law only in practice as a result of the consequences of the 1974 Turkish Invasion. If this so called break away republic is recognised by TURKEY it must lose its guarantor power under the 1960 Cyprus constitution. You cannot have a state within a state. Either Turkey recognises the TRNC or it doesn't - it cannot change its mind on a day to day basis.

The EU recognised as a member state the Cyprus Republic as established under the 1960 Constitution i.e. the entire island. It did note however that a solution must be found to resolve the ongoing issues between the two communities in accordance with UN resolutions. No need to detail them here.

No member of the EU recognises the TRNC illegal state and it is unlikely they will do so. Furthermore the EU has placed the resolvement of the Cyprus problem as a condition for TURKISH entry. It is not just an internal problem as you say but could easily become a European problem.

How can you say that the Turkish occupation is temporary after 34 years? Why has TURKEY sent settlers from the mainland to change the demographic population of the island ? The only reason Turkey has not been forced out is because Cyprus is of no interest to anyone.

It remains to be seen whether TURKEY will become a member of the EU.

I agree however that returning to the original status quo will be almost impossible because both communities are locked in their own position and neither side wishes to budge. I doubt very much whether the outside world is really interested in resolving the current situation.
