I don't think I'm protesting any points here anyway am I?
The due process of the law is under way and the case has been heard by two courts so far; one finding one way and one finding the other, just like people's opinions do. Pantheman 's opinion is that the driver of the car was being urged on to hit the moped, I am prepared to believe, until I hear otherwise, that the two passengers may have been so drunk they weren't even aware of what was going on, or that they may have been horrified by what was happening and urging him to stop. Only 3 people really know the answer to that absolutely and I am certainly not going to make any informed, or ill informed judgement either way. What happens in the next court may or may not be the end to the matter.
What I do find worrying about the whole matter is just the fact that passengers are being held responsible for the actions of the driver but it's not important enough to me at present to do anything.

So does that mean that you WILL be doing something about the situation if it DOES become important to you ?.

One wonders just what you will do in such an event, perhaps hit the canvas alongside Conor ?.

No Maynard I don't think I will because I don't envisage such a dangerous precedant in law ever being set. If I ever did however find myself being convicted of a crime for being a passenger in a car where a crime was committed by the driver I may have to re-evaluate my position.
However, I don't think I have the resolve to undertake such a gutsy action as Conor. I've only spent one night in a tent in my life when I was 21 and I don't think I want to repeat the experience. I rather like my luxuries in life. Whilst I may support other people's actions and admire their resolve in their fight for justice I might try to find some alternative way to get it for myself.

Feisty, in case of an accident, you are correct, the passengers are innocent. But let's put it this way, three men enter my house with intention to harm me, one of them has a gun and shoots me, are the other two innocent?

Oh Bollocks !!, looks like my cover has been blown already, sure the old caravan is exposed to the elements once again.

Did you ever consider becoming a detective ?, such perceptive qualities would be greatly appreciated I'm certain.

What with Conor placed strategically in the heart of the capital and you overseeing the procedures here, you would make a good win double. IMHO (well I'll be dogged !)

All I am saying Kafenes is that it's not cut and dried. I'm not pronouncing them innocent but also am not saying they are guilty either.
I am struggling with the conspiracy thing though as that clearly does imply intent but that does not sit with manslaughter because that is generally accepted to not be with prior intent. In the case you cite, you say that the men enter your house with intent to harm you. As I said before only 3 people know what went on in that car. I think any one of us can say we have been involved in an altercation of some sort in our lives but we know when to stop. I know that even if I had been involved in the earlier altercation and was on my way home with the designated driver that if he started something so terrible and dangerous that I would be screaming at him to stop it. I'm not prepared to say without any knowledge that it was not happening in this case.
I think it is a very complicated case as is indicated by the fact it is going through various courts.

Z4,
Locking them up for life is too good. Why throw away good money down the toilet. It would only cost around 20 Pence - for the price of a bullet! The death penalty is what the worst offenders deserve.

In Bulgaria, they used to have a 'two-strikes-&-you're-out' way of dealing with the worst offenders, including drink drivers. The second time that a drink driver was convicted in Bulgaria prior joining the E.U. were taken out,put up against a wall,& given the Nicolae Ceausescu Treatment (being shot).

Sorry for laying you bare.
I was advised once to become a Barrister and it was by a Barrister so the compliment was all the more welcome. He commented that no one would have been able to uncover the true in the many ways I had.
