AKP case falls at constitutional court

Postby umit07 » Wed Jul 30, 2008 5:44 pm

Turkey's constitutional court has just reached a verdict on the case calling for the closure of AKP. The court on the whole decided to cut AKP's treasury endowment by half. The verdict was reached with the following votes:

Closure of AKP: 6 votes
Cutting off treasury endowment: 4 votes
Case being completely overruled: 1 vote

7 votes were needed in order for AKP to be closed.

jesus, they were one vote short for closure of the government and he has the cheek to say it fell.

Those 6 judges obviously don't agree with the AKP and that to me spells disaster for future.

Anyway what does halving the treasury endowment mean?

is it some bulshit punishment just to save face to the world as to what might really have happened today.

Turkey is a loose cannon and she will explode some day soon and then god help us all.

So Turkey continues on the road to becoming another fundamentalist Islamic state.

May their Allah help them.

No room in the EU for non-secular countries.

Bye bye Turkey-stan  .... receding to the East!

Falling leaves find their roots  (as some ancient Chinese philosopher used to say).

Pantheman , I for one wanted AKP to be closed down but it has not happened. What I called the "Treasury endowment" is the money given to political parties as help from the government , I don't know what the Engilsh equivalent is . Anyway I thought you along with all the other GC's here wanted "Mama Turko" to blow up?

Turkey's governing party avoids ban
By Sebnem Arsu and Sabrina Tavernise Published: July 30, 2008

ISTANBUL: Turkey's highest court on Wednesday ruled against closing the governing Justice and Development Party but cut its state funding by half in response to charges that the Islamic-rooted party threatened the country's secular regime during its six years in power.

The case had paralyzed Turkish politics since the indictment was filed in March and had moved Turkey to a final confrontation between religious and secular Turks about who will rule the nation.

The indictment before the court accused the governing party, known as AK for the initials of its Turkish name, of trying to turn Turkey, a secular democracy, into an Islamic state.

It sought to close the party down and bar many of its members from politics.

"This ruling doesn't mean that the party has been cleared off charges," said Mithat Sancar, a law professor of Ankara University. "Cutting the party's treasury funds means that the evidence for the their anti-secular activity was there but not substantial enough to impose a ban. Therefore, they warned the party to be careful in their actions to avoid closure in the future."

With its control of the presidency, the Parliament and the government, the ruling party - led by Prime Minister Recep Tayyip Erdogan - has come farther than any other in modern Turkey in breaking the grip of the secular establishment on power.

The case, filed in March by Turkey's top prosecutor, called for banning the party on the grounds that it had steered Turkey, whose citizens are mostly Muslim, away from its constitutionally mandated secularism.

If the party had been found guilty, it could have been banned and 71 senior members, including President Abdullah Gul, and Erdogan could have been barred from politics for five years.

The case is part of a broader struggle between the party, whose members are observant Muslims, and the secular elite, which includes the military and judicial systems.

The party has largely defended Turkey's secular system of government, but the indictment accuses it of trying to impose Islam.

The 162-page indictment charged that because of Erdogan, Turkey is now seen as a "moderate Islamic republic," an image that it says has become the official view in the United States.

It cited former Secretary of State Colin Powell as "having defined our country" that way, "disregarding the fact that Turkey is a secular democratic state."

Erdogan, the indictment said, had bragged that he was co-chairman of the "Middle East Initiative," which it called "a U.S. project aimed at installing moderate Islamic regimes in countries."

Doesn't make sense to me

Don't worry. With oil prices at their current levels, Saudi Arabia will be sending plenty of finance their way!

Democracy at work. AKP have been given a warning and that suits me fine. They have less power now and are not free to do what they want. No coups no bloodshed.
