ECHR Rubber Stamps Land Exchange Deal

How can we solve it? (keep it civilized)

ECHR Rubber Stamps Land Exchange Deal

Postby Viewpoint » Wed Apr 02, 2008 8:29 am

Now you can exchange your land in the north for land in the south something GC thought would never happen. Thought provoking of where we are going. The ECHR has given the green light for exchanges and compensation via the TRNC property commission will GCs now apply as the TRNC government has in its possession the land of thousands of TCs exchanged for land in the north. Interesting times me thinks.

It was never illegal, as the "RoC" had it's people believe but now the rubber stamp is a good sign....

It has not been confirmed according to Cyprus Mail. The TCs do not own enough land to "exchange" with the GCs anyway and the commission does not work very well. I have posted my experience with them on this site before. If you don't like what the commission offers (exchange, compensation or restitution) you can then go back to the ECHR, so what's the problem. If this was a serious attempt at trying to solve the property issue why is the commission so difficult to find, why can't you access it through the TRNC website and why doesn't it have its own website encouraging GCs to do a swap?

Lets wait and see if it is full judgement regarding Property Commission being judge to be 1st port of call.

But either way puts the Guardian of TC properties (Can't find their web site) in a corner as the land in Larnaca contains two schools, residential homes and businesses. Did the TC agree to these developments so TC land is also being exploited which the GC's say can't happen for homes and business.

Perhaps it is just time the RoC took a leaf out of Turkeys book. You know ignore the judgement and tell them to F off, just like Turkey does.

Seems our hypocritical friends only like judgements in their own favour but reject everything else.

I think the RoC should appeal and make the case wait 6 million years to be heard

Eitherway its not as clear cut as the Turks would like, sorry to disappoint you.

This issue cuts both ways.

If a GC does not wish to exchange his/her land with TC land in the south and the 'trnc' refuses to give back the land of the GC then ECHR is the only recourse.

I don't believe that this case sets a precedent because this was a private agreement between Timbios and Turkey (via the so called property comission) and all the ECHR did was to rubber stamp it. It will need a proper pilot case for this commision to be deemed adequate remedy anyway. So this story is not over by any means.
