ECHR finds Turkey guilty of human rights violation

The European Court of Human Rights has found Turkey guilty of violating the human rights of Greek Cypriots, missing since the 1974 Turkish invasion of Cyprus. In its judgment the Court said Turkey is guilt of “the continuing violation of Article 2 of the European Convention on Human Rights on account of failure of the authorities of the respondent state (Turkey) to conduct an effective investigation into the whereabouts and fate of the nine first applicants who disappeared in life threatening circumstances”.
The decision, in the case of “Varnava and Others v. Turkey”, was taken by six votes in favour and one against, that of judge Gonu Eronen, representing Turkey.
The Court also announced that there was violation of Article 3 which prohibits inhuman treatment and Article 5 (right to liberty and security).
The applicants are 18 Cypriot nationals, nine of whom have been considered missing since they were taken into captivity by the Turkish army during military action in Cyprus in 1974. They have not been accounted for since.
The other nine applicants are the parents or wives of the missing applicants and based their application on Articles 2 (right to life), 3 (prohibition of inhuman or degrading treatment), 4 (prohibition of forced labour), 5 (right to liberty and security), 6 (right to a fair trial), 8 (right to respect for private and family life), 10 (freedom of expression), 12 (right to marry), 13 (right to an effective remedy) and 14 (prohibition of discrimination) of the European Convention.

It seems the majority of the TCs in this forum underestimate the power and importance of such legal decisions...
Never mind. One day they will understand it.

Btw has anyone noticed the only judge who objected is Mrs Emine Erk the newly appointed (supposely impartial TC judge)? Remember what she, and the other TC judge were saying before they were appointed? We did discuss this in this forum

So it was less of an "intervention" to restore peace to Cyprus and more an excuse to slaughter innocents and sweep away rightful conduct.

Turkey will have to account for all its crimes one by one and no amount of propaganda will save them now ...

I do agree with you, but the ramifications of any result, eitherway should have been forseen. When will they ever learn. :roll: It would have been a no win situation.

These people are missing, so someone must be responsible.

The tables were turned for 11 years before and it WAS NOT exactly the same remember? 800 dead in 11 years is not equal to 6000 dead in 1 month.

What Mrs Erk was saying, I've missed that.


She was saying something along the lines that law is science and she ill practice law and justice in the ECHR in a way totally irrelevant to her nationality.

She was appointed by TURKEY and she was supreme court judge in the occupied before that. Roc objected to the ECHR but the latter rejected RoC's objections.... Tough luck, they will now be paying a judge for nothing.

So in the end she proved exactly the opposite. 6 judges ruled against Turkey and she was the only one in favor.

Oh by the way TURKEY appointed another TC judge at the ECHR and he will be handling GC law suits against Turkey for the property issue!!!! Can you imagine?!!!
