PROBLEM WITH DEEDS OF LAND

i have two deeds of land in cyprus which l would like to sell one of them. the problem is that l have been informed that l owe only half of one. Yet on the deeds it states one name and l have to find out who is the other owner, which living in England is very hard to do.

Does anyone know how l go about this or any advice would be appreciated.

Hello Lizzie,

I have a couple of questions for you.

1. Where is your land situated ?
2. How do you know you only have half ?

The reason for question 1 is it will determine which land registry you will have to visit.

The reason for question 2 is because usually the other party is listed on the title too. I f you look in the colum to the right of the page it actually tells you the share.If it says ΟΛΟ, this is the whole, otherwise it tells you the fraction that is allocated to you.

If the title is shared and the other person is not listed, just go to the appropriate land registry and ask an agent (usually people who do all the paperwork for you) to apply for a search. The most you can hope for is a name. If they are in england you may not get an address, but if they were in cyprus they may have a previous address lodged.

Its easy enough to get the name but finding the person is another matter.

If you are sharing this with another person(s) how did you manage that? Are they family?Did you buy the share? Strange to have a share and not know who the other party is.

If indeed, it is shared then the land is a called Moushterekiko, and this has its own difficulties.

Thank you for your quick response. The land is given to him from his father. It is on the outskirts of Limassol. No other name is on the two deeds but it says 1/2 which is confusing.
As you know it is expensive to go to Cyprus and l was wondering if l have any chance of checking it out here. Also on the deed it shows the land total and it isnt halfed just the whole plot. It is quiet large.

Ok, here is where the problem begins.

If it says 1/2 then 1/2 is what you got.

You cannot check it from anywhere other than in cyprus.

You say him, does that mean you know this person? Is it an ex? Sorry to pry but seems you may not be giving the whole story here.

If it is in the limassol area then i guess then the Limassol land administration office is where you have to go. but if you cant find this person you cannot do anything with the land as you need his say so as he does yours.

How big is the land if you don't mind me asking and what is the location.

Then land registry in cyprus is very strict and its not easy to move property without the correct documentation AND the owner being present.

Thanks again. Shouldnt the deeds state two names though. The land in total is over 80.000 m2. another question is if the other half belongs to say a relative and they have sold it shouldnt they have contacted us?

If you can post a conclusion to this as I'm sure many on this forum will be interested.

I'll bet that when the deeds were issued they came as two pieces of paper stapled together ~ each bit of paper showing their names and the 50% share in the land ~ at a guess I would say the joint owner has taken the paper showing their half of the land ownership.

Go to the land registry local to your land and they will tell you who the other 50% owner is as it will be shown as one entry in their records ~ it's probably a relative so shouldn't be to much trouble to find them.

It will probably mean a trip to Cyprus but if you intend to sell the land I'm sure the expense can be justified.

You can get some really cheap deals with the holiday companies at this time of year and if you can travel at any time you could have a week or two weeks in Cyprus for between £100 and £150 on their late deals .

You can phone the Land Registry (I did this from the U.K.), tell them your problem and they will send you the right forms to fill in. You send these back with the fee ( I just put the right amount of Cypriot pounds in the envelope) and they will reply with the answers to your queries.

I did this to find out who owned what after my father died and the Paphos Land registry were extremely quick and very helpful.

Wow! Flippin heck you must have had a real lucky day. In my experience they wouldn't even talk to me as the land was in my wifes name, i had to get a document signed by her and veryfied by the muktur of the village before they would consider my application. All i wanted was a search of ajoining properties.

But, hey starnger things have happen, i suppose anything goes in cyprus, just depends who you happen to talk to on the day.
