I read it from milliyet. Yes It is true. But It is not related with the new Turkish Penal code.It was from old code. So we will saw result.

what what?
what you write is True.
But reason is not new code. And I dont think they can jail him.
At least not if they apply law.

It just happened recently. It was in today's newspaper.

Yes It is.
But they accused him acording to old code.
But that act didnt change much in new cold. Or news paper say it.
I dont think they can jail him from this act. It would be nonsense.

The trial of lawyer Medeni Ayhan launched yesterday and is proceeding in accordance with the new penal code.

Milliyet points out that it was in the first time in the country that "opining for the fact of Armenian massacres" is considered a crime. "If Ayhan is condemned for his views then the 216th article of the new penal code can be applied for those putting forward views opposing the state thesis. Thus, many intellectuals holding to different views than the official one will face trial as Ayhan


If they can not jail him, why is the trial already is process?

Because jailing you need a trial.And If you are innocent there wont be a jailing. Isnt this way a standart way? Someone just accused him until now.

By the way article 312 is article in old code. It becomes 216 in new code.

actually there is a trial to pay a fine as well not only to determine if you will go to jail.

but if the law says you can get arrested and pay a fine for using freedome of speech well then a trial wont help you much.

I know for jailing you need a trial. And he'll probably be jailed.

Didn't you read the article? This is the third time i'm posting this part. Read carefully.

This means that along with the expression "Armenian genocide" the "Armenian massacres" is also viewed as a penal action prosecuted by two -- 216 and 305 -- articles. The trial of lawyer Medeni Ayhan launched yesterday and is proceeding in accordance with the new penal code.


"If Ayhan is condemned for his views then the 216th article of the new penal code can be applied for those putting forward views opposing the state thesis. Thus, many intellectuals holding to different views than the official one will face trial as Ayhan".
