An open letter to Zaman’s Ata Atun and to the Turkish side!

Mr. Ata Atun, I read occasionally with great fascination your “diatribes” on the Cyprus issue, as they are published as a series of articles in Zaman! Today, I read another one such “brilliant discourse,” under the heading “Whose existence is illegal in Cyprus?

I have a question and a proposal to make to you, visa vie the issue of what is legal and what is illegal in Cyprus!

Since we Greek Cypriots claim that the Turkish invasion and occupation are illegal, but you do not; and since you and the rest of the Turkish side claim that the RoC, in its current existing status, is illegal, but we do not; why doesn’t Turkey accept and recognise the Jurisdiction of the International Court of Justice (ICJ) of the Hague, so that we all go there to have a hearing and a verdict by the only competent court to decide upon such matters?

We all accept to go there (ICJ,) Greece, Turkey, the RoC, the Greek and the Turkish Cypriot communities, each side will make its claims known to them, and we both will ask the court to examine the facts and give us a verdict! You -the Turkish /TC side, will claim that the existence of the RoC since 1963 is illegal and the Turkish “intervention” of 1974 and the since then occupation are legal, and we -the Greek /GC side, will claim the opposite! As simple as that!

Why is Turkey afraid to take such a step, in spite of the numerous invitations to do so, by the RoC and Greece?

The only reason I can think of, is because of the fact that you are not certain and you do not believe in the validity of your claims! :wink:

Kifeas thanx for the open letter to Zaman, however I cannot be bothered with Zaman one little iota..... good work though ;)

Can someone send an e-mail to Mr. Ata Atun on his address, ( [email protected] ) direct him to this thread and ask him to give us an answer to the above questions?

and i dont except either side as legal, but i do except either side as joke and i do except either side as betraying cypriot people, and i do except either side especialy those in power they have no interest in cypriot people they have interest only in lining their trouser pockets and their stomack linenings.................................. what a joke

Mr. Ata Atun, in his above article in Zaman, makes the above rediculus allegation:

Turkey has not recognized the legal authority of the ICJ since the late 1970s and thus Turkey taking the issue to The Hague is out of question. On the contrary, the Greek Cypriot administration can take the issue to The Hague if they are really confident in their strong position and claims.



Yes, it is true that Turkey has not recognized the legal authority of the ICJ since the late 1970s (one wonders why;) however, when a country does not generally and comprehensively recognize the jurisdiction of the ICJ, there is no way another one country that does (the RoC or Greece for instance,) can take the issue there, alone and unilaterally! The court will not accept such unilateral application! For this to happen, the country that doesn't recognize the ICJ in general, must give its consent in a written and mutually signed memorandum, with each side presenting their claims on it! Turkey refuses to do this, in spite all our numerous invitations since then!

One wonders why Turkey, a country that is a member of the UN and has co-signed the UN Charter through which the ICJ was established, a country that aspires to become an EU member and a country that claims a non-permanent seat in the UN SC, refuses to recognize the jurisdiction of such an important international tribunal such as the ICJ!

How is such a country entitled to claim legality in any case, and speak about international law in the first place, if it refuses to behave just like any other decent and civilized country of the world, which all accept the jurisdiction of international courts and the resolutions of international bodies such as the UN? Everyone wonders why? :lol: :lol: :lol:

It seems that neither Ata Atun, nor any of the TC ultra nationalists of this forum "wish" (read dare) to take up the challenge! They all run away like chicken!!!
