how do i go about getting the deeds for my apartment, bought august 2005 should the deeds be available now? is there any documentation posted to my apartment or do i collect somewhere. my details have already been recorded with land registry.

Hi Paul,

It's impossible to answer your question. It depends on a number of things:

- Is there are mortgage on the land on which the apartment is built? (If so you will not get the Deeds until the developer has paid off the mortgage).

- Has the development been finished ? (If not, there's no chance of getting Title Deeds until it is).

- If the development has been finished, has the developer applied to have the development inspected for the issue of a Certificate of Final Approval? (This certificate is required by the Land Registry before Titles can be issued). Note that if the development has been inspected & failed, you will not get Deeds until the problem's been resolved).

- Assuming that everything's OK and the development has passed inspection, has the developer applied for vertical division? (Once this is completed, you should get your Title Deeds).

But don't hold your breath - your lips will go blue. Devil's 5 to 10 year estimate is pretty good!

so can i assume that many of you do not have title deeds for your properties yet?

Have you paid off the property or is it still under a home loan? If the latter then the bank has the deed.

I got a 40000cyp mortgage which was used to pay the developer. i do have paperwork to say the developer has received this.

But you still haven't answered the simple question... have you paid off the property (mortgage) in full to the BANK?

I think you are missing the point here GR -- issue of the title deeds is dependant on many factors ( see Nigels post ) -- one of the biggest problems is usually the developer -- 5 to 10 years is not unusual from the date you move in and in some cases it can be much longer -- unlike the UK where you get your deeds straight away -- or should I say the bank gets them until you have paid off the mortgage.

To lots of Cypriots it doesn't seem to matter if they have the deeds or not and view it as a unnecessary expense that they will put off as much as they can-- I personally don't like the idea of paying for something and not being able to call it my own because the developer still owns it for up to 10 years after I've paid for it :shock: :roll:

The system in Cyprus really needs a shake up and there must be some way of preventing developers from taking out a mortgage / loan on property when it's already been sold :( or selling it with a mortgage attached :?
