Oh well, I will try and explain it one more time.
The actions in the RoC courts are actions in PERSONAM, against the persons misusing the property. No guarantees of title, no matter who gives them, are going to save the asses of the PERSONS in actual occupation of these lands.
The actions are not actions in REM, requesting repossession of the land, a remedy which the RoC courts cannot enforce.
The surest way to prevent such actions would be for Turkey to withdraw from the Council of Europe, retract its signature from the European Convention of Human Rights, stop all efforts to join the EU and then it will be in the clear. |
